Terms of Service for Bariatrack

Welcome to Bariatrack! These Terms of Service (“Terms”) govern your use of the Bariatrack mobile application (“App”), operated by SpiritWise Studios (“we,” “our,” or “us”). By accessing or using our App, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to comply with and be legally bound by these Terms. If you do not agree to these Terms, you may not use the App. You must be at least 18 years of age to use this App.

2. Description of Service

Bariatrack is a personal health and wellness tracking application designed to help users monitor their recovery following bariatric surgery. The App allows you to track fluid intake, protein consumption, supplements, meals, exercise, symptoms, and weight progress.

3. Medical Disclaimer

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The information and features provided by the App are intended for general wellness tracking purposes only and should not be considered a substitute for professional medical advice, diagnosis, or treatment from a qualified healthcare provider.

• Always seek the advice of your physician or other qualified healthcare provider with any questions you may have regarding your bariatric recovery or a medical condition
• Never disregard professional medical advice or delay in seeking it because of information provided by the App
• The dietary phase guidelines, nutritional targets, and recovery milestones in the App are general recommendations and may not be appropriate for your individual medical situation
• In case of a medical emergency, call your doctor or emergency services immediately

4. User Responsibilities

You are responsible for:

• The accuracy of any health data you enter into the App
• Maintaining the security of your device and iCloud account
• Any decisions you make based on information displayed in the App
• Consulting with your healthcare provider before making changes to your diet, supplement regimen, or exercise routine
• Complying with all applicable laws and regulations in your use of the App

5. Subscriptions and Payments

The App offers both free and premium subscription tiers:

• Free Tier: Basic tracking features are available at no cost
• Premium Subscription: Additional features are available through monthly or yearly subscription plans
• All purchases are processed through the Apple App Store. Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
• You can manage and cancel your subscriptions through your Apple ID account settings
• Refunds are subject to Apple’s refund policy

6. Apple HealthKit Integration

The App may integrate with Apple HealthKit to read and write health data with your explicit permission. You may revoke this access at any time through your device settings. We do not use HealthKit data for advertising or data mining purposes, in accordance with Apple’s HealthKit guidelines.

7. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we handle your data. By using the App, you consent to the data practices described in our Privacy Policy. Your health and recovery data is stored locally on your device, with optional iCloud sync to your personal Apple account.

8. Third-Party Services

The App integrates with the following third-party services:

• Apple iCloud (CloudKit): Optional cloud sync of your data, governed by Apple’s terms of service
• Apple HealthKit: Optional health data integration, governed by Apple’s terms of service
• Open Food Facts: Food and barcode lookup service, governed by their terms at world.openfoodfacts.org/terms-of-use
• Apple App Store (StoreKit): Subscription processing, governed by Apple’s terms of service

We are not responsible for the practices, content, or availability of these third-party services.

9. Intellectual Property

The App and its original content, features, and functionality are and will remain the exclusive property of SpiritWise Studios and its licensors. The App is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of SpiritWise Studios.

10. Disclaimer of Warranties

Your use of the App is at your sole risk. The App is provided on an “AS IS” and “AS AVAILABLE” basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

We do not warrant that (a) the App will function uninterrupted or be error-free; (b) errors will be corrected; (c) the nutritional data from third-party food databases will be accurate or complete; or (d) the App will meet your specific health or recovery requirements.

11. Limitation of Liability

In no event shall SpiritWise Studios, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the App; (ii) any health decisions made based on information provided by the App; (iii) any inaccuracy in nutritional data from third-party sources; (iv) any content obtained from the App; and (v) unauthorized access, use, or alteration of your data, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

12. Indemnification

You agree to defend, indemnify, and hold harmless SpiritWise Studios and its officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the App or your violation of these Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the App will cease immediately. You may terminate your use of the App at any time by uninstalling it from your device.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
